• Bypass security measures or authentication systems

Abusive Behavior:

• Harass, threaten, or defame other users or staff
• Send spam or unsolicited messages
• Post offensive, hateful, or discriminatory content
• Engage in cyberbullying or harassment

Platform Misuse:

• Use bots, scripts, or automated tools to access content
• Share your login credentials with others
• Use the Platform for commercial purposes without permission
• Resell, redistribute, or republish prompts without authorization
• Access the Platform from restricted countries or regions

Security Threats:

• Introduce viruses, malware, or harmful code
• Attempt to gain unauthorized access to other accounts
• Conduct denial-of-service (DoS) attacks
• Create security vulnerabilities

2.3 Enforcement

We reserve the right to:

• Terminate your account if you violate these Terms
• Report illegal activity to law enforcement
• Pursue civil or criminal action
• Ban you from using the Platform permanently

Upon termination:

• 7-day money-back guarantee

Credit System:

• Each premium prompt costs credits depending on complexity
• Credits can be used at your own pace
• Unused credits remain in your account indefinitely

4.4 Payment Processing

We accept payments via:

• Razorpay

Payment Terms:

• Payment is due immediately upon purchase
• We will charge your payment method on the date you authorize the purchase

4.5 Billing Disputes

If you notice an unauthorized charge or billing error:

2. Provide your transaction ID and order details
3. We will investigate within 7-10 business days
4. We will issue a credit or refund if an error is confirmed

Fraudulent Charges:

• If you believe a charge is fraudulent, contact your payment provider immediately
• You may also dispute the charge through your payment method’s dispute process
• We will cooperate with payment processors to investigate

4.6 Currency & Exchange Rates

• All prices are displayed in USD
• International users may incur additional fees from payment processors or banks
• We are not responsible for currency conversion fees, foreign transaction fees, or exchange rate fluctuations

4.7 Promotional Offers

• Promotional pricing (e.g., launch offers) is valid only during specified periods
• After promotional periods end, regular pricing applies
• Promotional codes are non-transferable and have no cash value
• We may withdraw or modify promotional offers at any time

5. CREDITS & USAGE

5.1 What Are Credits?

Credits are virtual currency used to access premium prompts on our Platform. Each prompt has a credit cost that varies based on complexity and value.

5.2 Credit Expiration Policy

Credits NEVER expire. You can use your credits anytime, at your own pace, for as long as you maintain your account.

5.3 Credit Usage Limits

Free Users:

• Limited to a specified number of free prompts per day
• After reaching the daily limit, you must log in to access more free prompts
• No credit requirements

Paid Users:

• Unlimited access to prompts after login (subject to credit balance)
• Credits are deducted for each premium prompt accessed
• Can use credits at your own pace

5.4 Credit Restrictions

• Credits can only be used by the account holder
• Credits cannot be transferred to other accounts
• Credits cannot be converted back to cash or other currency
• Credits cannot be refunded (except within the 7-day guarantee period)
• You cannot sell or trade credits

5.5 Running Out of Credits

If you exhaust your credits:

• You can still access free prompts (daily limits apply)
• To access more premium prompts, you must purchase additional credits
• Free prompts are always available at no cost

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Platform Content Ownership

All content on the Platform, including:

• AI prompts
• Text, graphics, and images
• User interface design
• Code and software
• Databases and collections

Are owned by or licensed to Vibhaga Group and are protected by copyright, trademark, and other intellectual property laws.

6.2 Prompts & Intellectual Property

Our Ownership:

• We own the intellectual property rights to all prompts on the Platform
• We license prompts to you for personal, non-commercial use only
• You do NOT own the prompts you purchase; you only have a license to use them

Your License to Use Prompts:
You are granted a limited license to:

• Use prompts for personal projects
• Modify prompts for your own use
• Use prompt outputs for commercial purposes (if permitted by the AI tool’s terms)

You are NOT permitted to:

• Sell, resell, or distribute prompts to others
• Republish prompts on other websites or platforms
• Claim ownership of prompts
• Use prompts for creating competing services
• Share prompts outside your organization (teams may purchase their own plans)

6.3 Model Training & AI Development

By using the Platform, you agree that:

• We may use aggregated and anonymized prompt data to improve our AI models
• We may analyze prompt trends and usage patterns
• We may develop new features based on user feedback
• Your individual prompts may be used for machine learning purposes

We will NOT:

• Share your personal data with third parties for model training
• Use your data in ways that violate your privacy

To Opt-Out:

• Email us at info@vibhaga.com with “Model Training Opt-Out” in the subject line
• Your prompts will not be used for future model training

6.4 User-Generated Content

If you upload, create, or submit content to the Platform:

• You retain ownership of that content
• You grant us a perpetual, royalty-free license to use, modify, and distribute that content
• You represent that you own or have rights to all content you submit
• You agree that content may be used for service improvement and analytics

6.5 Copyright Infringement

If you believe content on our Platform infringes your copyright:

1. Send a DMCA takedown notice to info@vibhaga.com
2. Include: Your name, work identification, alleged infringing URL, and statement under penalty of perjury
3. We will investigate and remove content if the claim is valid

You may be liable if you falsely claim copyright infringement.

7. USER CONDUCT & CONTENT POLICY

7.1 Acceptable Use

You agree to use the Platform only for lawful purposes and in ways that:

• Do not violate applicable laws or regulations

7.2 Prohibited Content

• Harassing, bullying, or threatens others

7.3 Moderation & Enforcement

We reserve the right to:

• Review content you submit
• Remove content that violates these Terms
• Suspend or terminate your account
• Report illegal activity to authorities
• Pursue legal action

8. LIMITATION OF LIABILITY

8.1 Disclaimer of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE” without warranties of any kind.

We do NOT warrant that:

• The Platform will be error-free or uninterrupted
• Content will be accurate, complete, or reliable
• Defects will be corrected
• The Platform will meet your expectations

8.2 Limitation of Liability

To the maximum extent permitted by law, we are NOT liable for:

• Direct, indirect, incidental, special, or consequential damages
• Lost profits, data loss, or business interruption
• Damages arising from your use of the Platform
• Errors, omissions, or delays in content
• Unauthorized access or data breaches
• Third-party actions or content

Even if we have been informed of the possibility of such damages.

8.3 Cap on Liability

Our total liability to you shall not exceed:

• The amount you paid for credits in the last 12 months
• OR $100 USD
• Whichever is LESS

8.4 Governing Jurisdiction

Some jurisdictions do NOT allow limitation of liability. If you are in such a jurisdiction, these limitations may not apply to you.

• Email: Mailchimp, SendGrid, Mailgun

9.2 Third-Party Terms & Privacy

• We are NOT responsible for third-party services

• Your use of third-party services is governed by their terms

The Platform may contain links to external websites. We:

• Do NOT endorse external websites
• Are NOT responsible for their content
• Do NOT control their policies or practices

10. REFUNDS & RETURNS

10.1 Refund Policy

We offer a 7-day money-back guarantee for all paid plans.

Eligibility:

• Refund must be requested within 7 days of purchase

10.2 Refund Processing

After the 7-day period, the following are NON-REFUNDABLE:

• Subscription fees
• Promotional or discounted items

Exception: If a refund is issued, all corresponding credits will be removed from your account.

10.4 Full Account Deletion

If you delete your account:

• Your data will be deleted after 1+ month
• No refunds will be issued for remaining credits
• Your account cannot be recovered

13.3 Governing Law

These Terms are governed by the laws of India (specifically, the applicable laws of Telangana, India).

For EU users: GDPR and EU consumer protection laws apply in addition to Indian law.

For California users: California law applies alongside these Terms.

13.4 Dispute Escalation & Jurisdiction

If informal resolution fails:

1. Either party may initiate legal proceedings
2. Legal proceedings shall be filed in the Hyderabad District Court or Higher Courts of Telangana, India
3. Both parties agree to submit to the exclusive jurisdiction of these courts
4. You waive any objection to venue or inconvenient forum

Venue & Forum: The courts of Hyderabad, Telangana, India shall have exclusive jurisdiction to hear and determine any dispute arising under these Terms.

14. TERMINATION

14.1 Termination by You

You may terminate your account at any time by:

1. Logging into your account
2. Going to Settings → Account
3. Clicking “Delete Account”
4. Following the confirmation steps

Upon termination:

• Your access to the Platform will be immediately revoked
• Your data will be retained for 1+ month, then deleted (except financial records)
• No refunds will be issued
• All terms remain in effect for content you’ve already accessed

14.2 Termination by Us

We may terminate your account immediately if:

• You violate these Terms
• You engage in illegal activity
• You abuse Platform features
• Your activity poses a security risk
• You create multiple accounts to circumvent restrictions

Upon termination:

• Your access will be immediately revoked
• You will not be entitled to refunds

14.3 Effect of Termination

Termination does NOT relieve you of:

• Any obligations you incurred before termination
• Any disputes or claims
• Your liability for past violations
